Terms of Service

Reservations and Payments:

• All reservations will be considered provisional until confirmed by email, WhatsApp message, or phone call from Rental Boat Marbella.

• To confirm the reservation, a prepayment is required. This prepayment will be:

-Non-refundable, except in the following cases:

• Unavailability of the selected boat

• Impossibility to agree on an alternative date proposed by the company

The total amount must be completed before the date of the activity.

We accept payments by credit card and cash:

• Cash payments can be made directly to the captain on the day of rental, at no additional cost.

Cancellations and Refunds:

Cancellations eligible for a full refund:

• 100% refund if the cancellation is made within 24 hours of booking, due to force majeure duly documented (serious illness, accident, or documented legal restrictions).
  This policy does not apply if the booking was made less than 3 days in advance of departure.

• 100% refund if the cancellation is made 7 days or more in advance of check-in.

• 100% refund if the cancellation is made by the company due to:

  • Adverse meteorological conditions, assessed by the captain (waves over 0.7 m or winds exceeding 7 knots).

  • Technical failures of the boat.

  • Force majeure preventing the service from being provided.

Cancellations ineligible for a refund:

• Cancellations made less than 7 days in advance of check-in.

• Customer's no-show on the day of rental.

• Errors attributable to the customer during booking (e.g.: choosing the wrong date or product due to not reading conditions and characteristics).

• Early termination of rental by customer’s decision: no hours or days unused will be refunded.

• Delays If the customer is late, the time lost will not be recovered. The possibility of extending the service depends on the availability of the crew and subsequent reservations.
  Furthermore, in the case of boats without a hired captain, a delay in return to port exceeding 15 minutes of courtesy may incur additional charges: 30 Euros for each 15-minute delay.

Weather Conditions

If on the day of the activity adverse meteorological conditions arise (waves exceeding 0.7 m or winds above 7 knots), the captain may cancel the departure for maritime safety.

In this case, the customer will be offered:

• An alternative date during the same season, or

• If reschedule is not possible, a booking voucher valid for 1 year, to be used in the following season.

Rental Conditions

The renter must:

• Be of legal age (18 years or older).

• Hold a valid boating license if required by applicable legislation.

• Attend a safety and orientation briefing before departure.

• Comply with all legal and maritime regulations during the rental.

• Be responsible for the proper use of the boat and for any damage or equipment loss due to negligent use.

Safety and Responsibility

Life jackets and mandatory safety equipment will be provided on board. The use of this equipment is mandatory according to the captain’s instructions or applicable regulations.

It is strictly prohibited to operate the boat under the influence of alcohol or drugs, in conformity with Spanish maritime legislation.

Rental Boat Marbella assumes no liability for personal injuries, material damage, or losses sustained during the use of the boat, except in cases expressly provided by law.

Acceptance of Terms

By booking and/or signing the rental agreement, the customer declares having read, understood, and accepted these terms and conditions.

Rental Boat Marbella reserves the right to modify these conditions without prior notice, while always complying with applicable legal regulations.
